1. About these Terms

These Terms of Service govern the supply of products by Begili Pty Limited (ABN 60 625 960 330), trading as Begili (we, us or our), through outdoorbegili.com.au (Website).
By accessing the Website, placing an order or purchasing a product from us, you agree to these Terms. If you do not agree, please do not place an order through the Website.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

2. Website use and customer information

You may place an order only if you are legally capable of entering into a binding contract. You must provide accurate, current and complete information when purchasing from us or contacting us. You must not use the Website for an unlawful purpose or interfere with its operation or security.

3. Products and product information

Begili sells outdoor furniture supplied as flat-pack furniture for customer self-installation, unless a product page expressly says otherwise. Please read the product specifications, inclusions, dimensions, materials, care instructions and assembly information before placing an order.
We take reasonable care to display product images, colours and descriptions accurately. However, colours may vary slightly due to device-screen settings, lighting and natural variation in materials such as timber. This does not affect your rights if a product is materially different from its description, sample or displayed specifications.
Product availability is subject to stock levels. We may limit quantities where reasonably necessary. We will not knowingly accept payment for a product that we do not intend, or know we cannot reasonably, supply.

4. Pricing, GST and promotions

Unless stated otherwise, all prices on the Website are in Australian dollars (AUD) and include GST. Applicable delivery charges are shown at checkout before you submit your order.
Prices, promotions and availability may change before we accept an order. A price displayed on the Website is an invitation for you to place an order; it is not an offer capable of acceptance by you. Once we accept your order, we will not increase the product price or add an undisclosed mandatory charge.
If we identify a genuine pricing, promotion or product-description error before accepting an order, we may correct the error and contact you to confirm whether you wish to proceed. If you do not wish to proceed, we will cancel the affected order and refund any amount already paid.
Promotions are available only for the stated period and in accordance with their displayed terms. Any exclusions, minimum spend requirements or geographical limits will be disclosed on the relevant product, promotion or checkout page.

5. Orders and contract formation

When you submit an order, you make an offer to purchase the selected products on these Terms. An automated order-receipt email confirms that we have received your order; it does not mean we have accepted it.
A binding contract is formed when we send you an order-confirmation email, dispatch-confirmation email, or otherwise confirm acceptance of your order. We may decline an order before acceptance where, for example, the product is unavailable, payment has not been authorised, there is a material pricing or product error, or we reasonably suspect fraud or unlawful activity. If we decline an order after receiving payment, we will refund the amount paid for the affected product.

6. Payment

Payment must be made using a method made available at checkout. You authorise us and our payment service providers to process payment for an accepted order.
We use third-party payment providers. We do not store your full payment-card details. Payment processing is subject to the relevant provider’s terms and privacy practices.

7. Delivery

7.1 Delivery locations

We currently deliver only to addresses in New South Wales, Queensland, Victoria and the Australian Capital Territory. We do not currently offer international delivery.

7.2 Delivery charges

We offer free standard delivery within 50 km of Sydney and Brisbane, subject to confirmation of the delivery address at checkout. For eligible addresses outside those areas, the applicable delivery charge will be shown at checkout before you place your order.

7.3 Dispatch timing

We aim to dispatch accepted orders within 3 to 7 business days, subject to stock availability, payment approval, delivery-address confirmation and circumstances outside our reasonable control. Dispatch time is different from delivery time. Any delivery date or window is an estimate unless we expressly agree otherwise in writing.
If a material delay becomes known, we will provide reasonable updates and work with you on an appropriate solution. Your statutory rights are not affected if we fail to supply goods by an agreed date or within a reasonable time.

7.4 Delivery requirements

You must provide a complete and accurate delivery address, current contact details, reasonable access information and any relevant delivery instructions. You are responsible for ensuring that the delivery site is safely accessible for the selected delivery service.
If delivery cannot be completed because the address, access information or contact information you provided is incorrect or inadequate, or no authorised person is available where attendance is reasonably required, we may contact you to arrange a further delivery attempt. Any additional redelivery or storage cost will be disclosed before it is charged.
Risk in the products passes to you when products are delivered to the delivery address or collected by you or a person authorised by you. Title passes only when we receive payment in full.

8. Flat-pack furniture and self-installation

Unless a product page expressly says otherwise, Begili furniture is supplied flat-packed and requires customer assembly. You must follow the provided assembly instructions, warnings, care instructions and weight/load guidance.
You are responsible for using suitable tools, a safe assembly area and, where required, sufficient assistance to assemble and move furniture safely. Do not use a product that appears damaged, incomplete or unsafe; contact us promptly if there is a problem with the product or its components.
Nothing in this clause reduces your rights where a product has a fault, does not match its description or otherwise fails to meet a consumer guarantee.

9. Cancellation before dispatch

You may request cancellation of any order, including a custom order if one is offered, before the order has been dispatched. Please email sales@begili.com.au with your order number and the name used for the order.
A cancellation request is effective only when we confirm it in writing. If the order has not been dispatched, we will cancel it and refund the amount paid for the cancelled product to the original payment method within a reasonable time.
Once an order has been dispatched, the change-of-mind policy in clause 10 applies. This does not limit your rights under the Australian Consumer Law.

10. Change-of-mind returns

In addition to your statutory rights, Begili offers a voluntary 30-day change-of-mind return policy for eligible non-sale products. You must request the return within 30 days after delivery by emailing sales@begili.com.au with your order number and reason for return.
To be eligible, the product must be unused, undamaged, complete with all included parts and accessories, and in a resalable condition. Original packaging should be retained and used where reasonably possible. We may inspect the product before approving a refund under this voluntary policy.
You are responsible for arranging and paying return freight or collection costs for a change-of-mind return. Because furniture can be bulky, please contact us before arranging return transport so we can provide the correct return instructions.
Our voluntary change-of-mind policy does not apply to sale or clearance items, products that have been used, damaged after delivery, altered, assembled in a way that makes them not resalable, or returned without reasonably necessary components.
These exclusions do not apply to products that are faulty, unsafe, materially different from their description, or otherwise subject to a remedy under the Australian Consumer Law. Sale items retain the same statutory consumer-guarantee rights as non-sale items.
Where we approve an eligible change-of-mind return, we will refund the purchase price paid for the returned product to the original payment method. Original delivery charges and change-of-mind return freight are not refundable, except where required by law or expressly agreed by us in writing.

11. Faulty products and consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
If you believe a product is faulty, damaged, unsafe or does not match its description, please contact us promptly at sales@begili.com.au with your order number, a description of the issue and photographs where reasonably available. We may assess the product before deciding the appropriate remedy, except where the law provides otherwise.
For a major failure, you may choose a refund or replacement, or keep the product and seek compensation for the reduction in value where applicable. For a minor failure, we may repair the product within a reasonable time or provide another remedy required by law.
If a faulty product is large, heavy or difficult to return, we will arrange collection or pay reasonable return costs where required by the Australian Consumer Law. We will not require you to deal directly with a manufacturer or importer to obtain a remedy from us.

12. Two-year voluntary warranty

In addition to your rights under the Australian Consumer Law, Begili provides a two-year voluntary warranty from the delivery date for manufacturing defects in materials or workmanship in all products.
This voluntary warranty does not cover fair wear and tear, accidental damage, misuse, neglect, unauthorised alterations, failure to follow assembly or care instructions, or damage caused by conditions outside normal intended use. These exclusions apply only to the extent permitted by law and do not limit any consumer guarantee that applies to you.
To make a warranty claim, contact sales@begili.com.au with your order number, proof of purchase, a description of the issue and photographs where reasonably available.

13. Product care and safe use

Outdoor furniture should be used, maintained and stored in accordance with its product-specific care instructions. You should take reasonable precautions against unsuitable weather exposure, unsafe placement, overloading, improper assembly and use by children without appropriate supervision.
Product-specific weight limits, care instructions and safety warnings form part of product information. Nothing in this clause excludes liability for a product-safety issue or failure to comply with consumer guarantees.

14. Limitation of liability

To the maximum extent permitted by law, Begili is not liable for indirect or consequential loss that was not reasonably foreseeable and arose from misuse of a product, failure to follow assembly/care/safety instructions, unauthorised modification, or circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability for a remedy that cannot lawfully be excluded or limited, including rights under the Australian Consumer Law.

15. Intellectual property

Unless otherwise indicated, Website content, including the Begili name, logo, text, product images, product designs, graphics and layout, is owned by or licensed to Begili and is protected by applicable intellectual-property laws. You may use the Website for personal, non-commercial shopping purposes only.
You must not reproduce, distribute, modify, commercially exploit or create derivative works from Website content without our prior written permission, except as permitted by law.

16. Privacy

Our handling of personal information is governed by our Privacy Policy. By placing an order or contacting us, you acknowledge that we may collect, use and disclose personal information as described in that policy, including to process payment, dispatch and deliver orders, provide support, and meet legal obligations.

17. Website availability and third-party links

We take reasonable steps to keep the Website operating, but do not guarantee uninterrupted or error-free access. We may suspend or restrict access where reasonably necessary for maintenance, security or operational reasons.
The Website may contain links to third-party websites or services. Those links are provided for convenience only. We do not control and are not responsible for third-party content, terms, privacy practices or availability.

18. Changes to these Terms

We may update these Terms by publishing a revised version on the Website. The revised Terms apply to orders placed after the effective date displayed at the top of the revised document.
A change to these Terms will not retrospectively alter the key commercial terms of an order we have already accepted, unless the change is required by law or you agree to it.

19. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales and courts entitled to hear appeals from them have non-exclusive jurisdiction, subject to any consumer-law rights that apply to you.
If you have a concern or complaint, please contact us first at sales@begili.com.au or 1300 234 454. We will work with you in good faith to resolve the issue. Nothing in this clause prevents you from exercising a legal right or seeking assistance from a relevant consumer-protection agency.

20. General

If any provision of these Terms is unlawful, void or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue to apply.
A failure by either party to enforce a right is not a waiver of that right. These Terms, the applicable order confirmation, and the product, delivery, returns, warranty and privacy information made available at the time of order form the agreement between you and Begili for the relevant purchase.
